These Terms of Service ("Terms") govern your access to and use of pickem.guru and its subdomains and the pick'em game offered there (the "Service"), operated by Pickem Guru LLC ("we", "us"). By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account.
pickem.guru is a free-to-play contest of skill. You predict the straight-up winners of sporting events; you earn one point per correct pick, with a tiebreaker based on predicting the combined points of a designated game. Standings are determined by total points and the tiebreaker. No purchase is necessary to play, and the current Service does not involve wagering or real-money prizes. Results depend on your knowledge and judgment, not chance.
We may suspend or terminate accounts that violate these Terms or disrupt the Service.
Picks lock at each game's start time and cannot be changed afterward. Scoring and tiebreakers are applied as described in the game rules. We rely on third-party data for schedules and final scores and are not responsible for errors, delays, or corrections in that data; we may adjust results to reflect official outcomes.
You retain ownership of the limited content you provide (such as your nickname). You grant us a license to display it within the Service (for example, on leaderboards). We may remove content that violates these Terms.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Pickem Guru LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).
We may modify or discontinue the Service, and we may update these Terms, at any time. Material changes will be posted here with an updated effective date; continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.
